Industrial Design Registration: Protecting Product Appearance

Industrial design protection concerns the appearance of a product or part of a product. Lines, contours, shape, colour, texture and materials may contribute to the overall visual impression. Furniture, packaging, jewellery, patterns and device housings are examples where appearance can carry commercial value.

Separate appearance from function

A design registration does not replace a patent for a technical invention or a trademark for a commercial sign. These rights can complement each other on the same product. For example, a device may have a distinctive housing, a technical mechanism and a brand name that require separate assessments.

Novelty and individual character

The proposed design must satisfy the applicable novelty and individual character requirements. Earlier designs and public disclosures matter. A preliminary search can identify similar appearances, but it does not guarantee registration or success in a future dispute. Features dictated solely by technical function require particular care when defining the proposed protection.

Prepare the visual material

Use consistent views of the same design. Check that the images clearly show the appearance intended for protection and avoid contradictory details between views. Product descriptions, designer information, ownership and any earlier disclosure dates should be collected before filing. Where several designs are involved, assess their relationship and filing requirements rather than assuming a single image protects the whole range.

Renewal and portfolio planning

Registered Turkish designs are protected in five-year periods and may be renewed up to a total of twenty-five years. Keep renewal dates and ownership records current. Filing before public launch reduces uncertainty, particularly where protection abroad is planned. Özgel Patent supports the preparation of design applications and the review of images, dates and official communications for the intended filing strategy.
