International Trademark Protection and the Madrid System

Trademark rights are territorial. A Turkish registration does not automatically protect a brand in every export market. Businesses planning international sales should consider where the mark will be used, who will distribute the goods and which goods and services require protection in each market.

What the Madrid System does

The Madrid System, administered by WIPO, offers a central route for requesting trademark protection in designated members. It can simplify filing and later administration, including certain changes and renewals. It does not create an unconditional worldwide trademark. Each designated office applies its own examination rules and may issue a refusal or require a response.

The basic application or registration

An international application through the Turkish office is based on an eligible Turkish application or registration and the applicant's connection with the office of origin. Owner details, the mark and the requested goods and services must be checked for consistency. During the initial five-year dependency period, developments affecting the basic mark may affect the international registration.

Select markets deliberately

Prioritise existing exports, signed distribution arrangements and realistic expansion plans. Search the proposed mark in relevant markets and consider language or meaning issues. The most economical route depends on the countries, classes, fees and possible local representation requirements; central filing does not always remove all local costs.

Monitor what happens after filing

Record official notifications and country-specific response deadlines. A provisional refusal is a matter to assess, rather than proof that the entire international strategy has failed. Keep address and ownership changes aligned across the portfolio. Özgel Patent can help compare filing routes and prepare a market-based protection plan, with local professional assistance where the procedure requires it.
