Copyright and Trademarks: Different Rights, Complementary Protection
Copyright and trademarks protect different interests. Copyright concerns eligible original works, such as writing, photographs, music, software and visual creations. Trademarks identify the commercial origin of goods or services. A business may need both forms of protection, but one does not automatically replace the other.
How copyright arises
Under Turkish copyright law, protection for a qualifying work generally arises when the work is created. Optional registration is not the source of the right. Records can nevertheless assist in explaining authorship and dates in a dispute. Whether a particular item qualifies as a work and who holds the relevant rights must be examined from the facts and applicable rules.
Compare scope and duration
A trademark application identifies a sign and a list of goods and services. Trademark protection and renewal follow the registration framework. Copyright focuses on the protected expression and the rights associated with the work. As a general rule, the economic protection period is the author's lifetime and seventy years after death, with particular cases requiring separate assessment.
A logo can raise both questions
An original logo may function as a commercial sign and also contain copyright-protected expression. The company using it should check the designer's agreement, permissions and ownership records. Paying for artwork should not be assumed to resolve every issue about the transfer or licensing of rights. Similar questions arise with commissioned photographs and software.
Keep a useful evidence file
Preserve drafts, dated source files, contracts, delivery records and publication history. Separate materials created in-house from licensed third-party assets. Özgel Patent assists with copyright documentation and the coordination of suitable protection routes. If a dispute involves litigation, the evidence and legal strategy should be reviewed with the relevant lawyer before action is taken.
