Trademark Registration Guide: Goods, Services and Filing Scope

Choosing the scope of a trademark application begins with the goods and services supplied under the mark. Nice classes organise this scope; a business activity code or class number alone does not describe it. This guide explains how to prepare a useful list, evaluate the sign and follow the application.

1. Identify the sign, owner and use

Confirm the name, logo or other sign to be protected and the applicant who will own it. Explain whether it appears on packaging, in a shop, within software or as a service brand. Company registration, domain ownership and social media use do not replace trademark registration. Different activities of the same business may require different classes.

2. Research the mark together with the scope

Search identical and similar signs and consider earlier rights and distinctiveness. Similar spelling is only one part of the review. The goods and services, meaning, appearance and relevant use need to be examined together. A favourable preliminary search is not a guarantee that the office will accept the application or that no opposition will be filed.

3. Describe concrete goods and services

Nice classes 1–34 concern goods; classes 35–45 concern services. Explain the product's nature and purpose and how the service is supplied. Being in the same class does not make all goods identical. Reading a class heading is not a substitute for selecting appropriate detailed terms from the current official list.

Examples that show why wording matters

Clothing is a product commonly considered in class 25. Coffee products and café services raise different questions, commonly involving classes 30 and 43. Downloadable software is distinguished from software development or SaaS services, commonly considered in classes 9 and 42. Retail or wholesale services involving goods are assessed separately from the branded goods themselves.

Does class 35 protect every product?

No. Bringing goods together for sale is a service, while the goods carrying the mark are a separate protection subject. A packaged coffee brand, a café and a shop selling several brands should not be treated as the same scope. Identify the actual goods, the sales service and any additional services. Our English class finder offers an initial orientation, with the exact terms checked against current official sources.

4. Check the current edition

The supplied 2024 goods-and-services document is a historical version. Compare it with the current TÜRKPATENT list before preparing a new application. Classification and wording can change. In the 2026 Turkish list, ordinary spectacles, sunglasses and lenses are considered in class 10, while protective and swimming goggles require the separate class 9 assessment. The product's intended use remains important.

5. Review the application file and costs

Check applicant details, the exact mark sample, the selected terms and representation information as one consistent file. Distinguish official fees from consultancy charges. Confirm current fees and notification periods for the procedure being undertaken. Avoid selecting unused areas merely to make the application appear broad; real use and realistic expansion plans should guide the discussion.

6. Follow the application after filing

Filing does not complete registration. Examination, publication and any opposition must be monitored, with deadlines recorded. After registration, keep use evidence, ownership records and renewal reminders. If foreign markets are planned, review country selection and the filing route separately. An international registration is not automatic worldwide protection.

Prepare for the first discussion

Bring the name and logo examples, separate lists of products and services, earlier application details and intended countries. Distinguish manufacturing, sales, maintenance, training and software activities. Özgel Patent can help organise these facts into a filing strategy. The result of the application remains subject to the competent office's examination and any relevant proceedings.
