Patent or Utility Model: Understanding the Difference
A patent and a utility model can protect eligible technical inventions, but their requirements and scope are different. The choice should follow a technical review of the invention, the existing knowledge and the intended markets. It should not depend only on which application appears cheaper or faster.
Patent requirements
A patentable invention must satisfy novelty, inventive step and industrial applicability requirements. A Turkish patent can provide protection for up to twenty years from filing, subject to the applicable maintenance obligations. Products and processes may be eligible, depending on statutory exclusions and the technical subject matter. The claims define the protection being requested; a commercial description alone is insufficient.
Utility model requirements
Utility models require novelty and industrial applicability, while inventive step is not assessed in the same way as for patents. A Turkish utility model can last up to ten years. Search is still part of the process. Certain subject matter, including processes and other statutory exceptions, is excluded. An improvement to an existing product does not automatically qualify simply because it is useful.
Compare the commercial situation
Consider the product life cycle, competitors, manufacturing plans, available budget and foreign protection needs. A technically important feature may justify a different filing strategy from a short-lived modification. Neither route guarantees that the final claims will cover every competing product.
Keep the invention confidential
Public demonstrations, online publications, sales offers and trade fairs can affect novelty. Plan filing before disclosure and record any previous disclosures for professional assessment. Prepare drawings, the technical problem, the proposed solution and differences from known products. Özgel Patent can help organise an initial search and compare the available routes before an application is prepared.
