Utility Model Applications: Search Reports and Protection Criteria

A utility model may be a suitable route for an eligible technical invention in Turkey, but it is not a registration for every useful product. Novelty, industrial applicability, the proposed claims and statutory exclusions must be examined together. A commercially successful improvement may still need substantial technical assessment before filing.

Compare the protection criteria

Patents require novelty, inventive step and industrial applicability. Utility models require novelty and industrial applicability without the same inventive-step assessment. Certain subject matter, including processes and other statutory exceptions, is outside utility model protection. The decision should follow the nature of the invention rather than a general promise of fast registration.

Search is part of the procedure

A utility model application should not be planned on the assumption that no search report is needed. Search results may identify documents relevant to novelty. These documents must be compared with the claimed technical features and the relevant filing or priority date. Official notices and response requirements should be reviewed carefully.

Prepare the technical description

Explain the technical problem, the proposed solution and the features that distinguish it from known products. Drawings and claims must be consistent with the description. Marketing benefits alone do not define the invention. Record any earlier demonstrations, sales, publications or discussions, including who received the information and whether confidentiality arrangements existed.

Plan the commercial life cycle

A Turkish utility model can last up to ten years, subject to the applicable obligations; a patent can last up to twenty years. Time and cost depend on the file, current fees and procedural developments. Özgel Patent supports preliminary technical review, search planning and the comparison of protection routes. Filing before public disclosure is a practical starting point for reducing uncertainty, especially if overseas protection is also intended.
